Terms of Service

The agreement between you and Togra when you use the Togra apps, our website, our emails and everything else we offer. We've written it so you can read what you're agreeing to.

In short

  • What you make is yours. You give Togra permission to store it and show it to the people you chose.
  • Leave things only where you’re allowed to, and never at someone’s home or somewhere dangerous.
  • You’re responsible for your own safety when you go to a place. Don’t trespass, and don’t use Togra while driving.
  • Don’t fake your location, harass anyone, or use Togra to follow someone.
  • Everything you do with friends is free. Paid plans renew until you cancel, and credits have no cash value.
  • Nothing here takes away the rights you have as a consumer under the law where you live.

1.This agreement

These Terms are an agreement between you and Togra (“Togra”, “we”, “us”), based in Nairobi, Kenya. They cover everything Togra offers: the Togra apps for iPhone, Android and the web, our website, our emails and newsletter, Togra for creators and businesses, and any Togra platform or developer services (together, “Togra”). By using Togra, you agree to them. If you don’t agree, please don’t use Togra.

Some features have extra terms, like business plans, creator payouts or developer access. We show you those before you use the feature, and they add to these Terms.

Our Privacy Policy explains how we handle your information, and is part of these Terms.

2.Who can use Togra

3.Your account

Give us accurate details and keep your sign-in safe. You are responsible for what happens in your account. Tell us straight away if you think someone else is using it. One person, one personal account: don’t pretend to be someone else.

4.Your content

What you make on Togra, your Drops, Posts, messages, photos, videos, voice notes, Trails and capsules, belongs to you.

So that Togra can work, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, adapt (for example resizing a photo or transcribing a voice note) and show your content to the audiences you chose, and to run and improve Togra. You can’t take back content you’ve already shared with someone, but when you delete something, this licence ends for it, except for copies others already have, backups that expire on their own schedule, and anything the law requires us to keep.

You promise that you have the right to share what you share, and that it doesn’t break anyone’s rights or the law. Don’t upload someone’s private image or information without their permission.

5.Leaving things at places

Places are part of what you share, so choose them with care.

Togra may move, limit or remove anything that breaks these rules, or that people report as unsafe, while we look into it.

6.Going to places

Togra shows you that something is waiting at a place. It can’t promise that the place is open, safe, accessible or unchanged.

7.A place’s past, capsules and Legacy

If you choose to leave something to a place, you also give Togra permission to keep it after its public time on the map, so it becomes part of that place’s past; to show it to people who stand there later; and to include it in collections, archives and exhibitions of how places were lived, on Togra and beyond. You decide whether your name stays with it. You can take it back, and when you do, this permission ends for it.

Capsules stay sealed until the time and for the people you chose. With Legacy you decide what of yours stays when you are no longer here, and who looks after it.

Togra keeps a place’s past for as long as it can, but we can’t promise that anything will last forever.

8.Community rules

Togra is for people who want to leave good things for each other. You must not:

If something breaks these rules, report it in the app. We act on credible safety reports first and review second.

9.Messages, calls and Live

10.Honest location and fair play

Some things only open when people are really there, so you must not:

11.Creators, businesses and Claims

12.Selling on Togra

Creators and businesses can sell things on Togra, like tickets, paid experiences and exclusive releases. When you buy from them, your purchase is with that creator or business; Togra provides the tools and processes the payment. The seller is responsible for delivering what they sold, and for their own refunds, taxes and legal obligations, unless we say otherwise at checkout.

If you receive payouts, you must give us accurate details and complete any identity checks the law or our payment providers require. We may hold or reverse a payout involved in fraud, a chargeback or a breach of these Terms.

14.AI features

Some features use AI to help you, like drafting a Drop from a voice note, suggesting the stops of a Trail, or answering a question about the map. AI suggests and drafts; you decide. Check a draft before you publish it, because AI can be wrong. Don’t rely on AI answers for anything to do with your safety or health.

15.Developers and the Togra platform

If you build with Togra’s developer tools or APIs, you must follow our developer terms, respect people’s privacy choices, never collect or sell anyone’s location, and use Togra data only for what the people it belongs to agreed to.

16.New and early features

Sometimes we let people try a feature early. Early features may change, stop working as expected or be removed, and we may ask for your feedback on them.

17.Togra’s rights

Togra, its name, logo, designs and software belong to us. We give you a personal, non-transferable licence to use the Togra app and website for their intended purpose, under these Terms. Please don’t use our name or logo in a way that suggests we endorse you.

If you send us ideas or feedback, we may use them without owing you anything.

18.Other services

Togra works with other services, like GIFs from GIPHY, place details from Google Maps, sign-in with Google or Apple, and payments through our payment providers and the app stores. Their own terms apply to them as well. We aren’t responsible for other services, or for websites that Togra links to.

19.Ending your use of Togra

You can stop using Togra and delete your account at any time.

We may limit, suspend or close an account that breaks these Terms, puts people at risk, or that the law requires us to act on. Where it is safe and lawful, we tell you why and give you a way to appeal. If we close Togra or a paid feature, we give you notice and a fair refund for any paid time you can no longer use.

20.Disclaimers

We work hard to keep Togra running well and safely, but we provide it “as is”. As far as the law allows, we don’t promise that Togra will always be available, error-free or suitable for a particular purpose, or that what people leave on it is accurate. Content on Togra is the responsibility of the person who made it.

21.Our liability

As far as the law allows, Togra is not liable for indirect or consequential losses, such as lost profits or lost data, or for anything that happens when you go to a place because of something on Togra.

Nothing in these Terms limits liability that can’t be limited by law, including for death or personal injury caused by negligence, or for fraud, and nothing takes away your rights as a consumer, including under Kenya’s Consumer Protection Act, 2012.

22.Disagreements and the law

If something goes wrong, please write to us first at hello@togra.space, and we will try to fix it.

These Terms are governed by the laws of Kenya, and the courts of Kenya can settle any dispute. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws where you live, and you can bring a claim in your local courts.

23.Changes to these Terms

When we change these Terms, we update the date at the top. If a change matters, we tell you before it takes effect, in the app or by email. If you keep using Togra after that, the new Terms apply. If you don’t agree, you can stop using Togra and delete your account.
